Marital Rape: A Crime Deserves the Whip of Law

India is rapidly growing and changing. This country has made much progress since Independence. In present political scenario this country has a female head of the state. Here women have excelled in different fields and they can rise to the top positions, still there are untouched brutal stories of pains and miseries. Here women are still denied their right to live with dignity in the institution of marriage. Half of their lives are spent in debilitating pain. The institution of marriage was historically designed by and for men to control the women. Here it is like a license and legitimacy to violate the right over one’s own body. It is the right time to uncover the stories of marital rape in Indian society. The marital rape exception in criminal law is a colonial relic. It deserves the whip of law because for too many women, home is not a sanctuary but a space of mental and physical violence. This Research Paper intents to explore the need of reforms in marriage institution by applying the theories of Feminism, Deconstruction, Performativity and Psychoanalytic. The Researcher has heard several stories on this crime and read numerous stories written by women writers. Every woman has a right to be safe and healthy. She has a right to a voice and freedom of expression but it’s the alarming situation that majority of women feel voiceless, helpless and trapped in the yoke of marriage. The prevalent awkward silence on this severe issue shows apathy towards women in Indian society. This deafening silence makes them ripe for more and more exploitation.
