Criminal Law Reforms in India

India’s criminal justice framework underwent a historic transformation with the enactment of three ground-breaking statutes in 2023: the Bharatiya Nyaya Sanhita, the Bharatiya Nagarik Suraksha Sanhita, and the Bharatiya Sakshya Adhiniyam. These laws replace the erstwhile criminal justice architecture and aim to address long-standing challenges such as procedural delays, outdated offence definitions, low victim participation, and the absence of legal accommodation for digital evidence. This research paper critically analyses the need for these reforms, examines their philosophical underpinnings, evaluates their substantive and procedural innovations, and assesses empirical evidence of their early impact. The paper also identifies implementation challenges and proposes strategic policy recommendations to ensure that the transformative potential of these laws is fully realised.
